Terms & Conditions METHOD OF SALE: Halderman Real Estate Services, Inc. (HRES, OH Auct. Lic. #2001014575) will offer this property by sealed bid auction on March 21, 2019. Bids must be received no later than 4:00 PM EST that day. Each bid shall constitute an offer to purchase and the final bid, if accepted by the Seller, shall constitute a binding contract between the Buyer(s) and the Seller. The auctioneer will settle any disputes as to bids and their decision will be final. BID FORMAT: All bids must be received by Jim Hanna and/or Robert McNamara of Halderman Real Estate at PO Box 865 or 160 W Locust St, Wilmington, OH 45177 by 4:00 p.m. on March 21, 2019. Bids may be personally submitted or emailed to jimh@halderman.com or robertm@halderman.com. All bids must be received by 4:00 PM EST on March 21, 2019. ACREAGE: The acreages listed in this brochure are estimates taken from aerial photos and mapping software. SURVEY: The Sellers will have a new survey completed, the cost of which will be paid by the Sellers. The Sellers will choose the type of survey to be completed and warrant that it will be sufficient to provide an owner’s title insurance policy for the tract. When a survey is completed, the purchase price for the surveyed tract will be adjusted, up or down, to the exact surveyed acres. The bid price per acre will be then times the final surveyed acreage to conclude with a total dollar purchase price. An estimate of 80 acres is for the brochure and mapping purposes. DOWN PAYMENT: 10% of the bid down upon acceptance of the bid with the balance due at closing. The down payment must be in the form of personal check, cashier’s check, corporate check or wire. CLOSING: The closing shall be on or about April 25, 2019. However, the Seller has the choice to extend this date if necessary. POSSESSION: Possession of land will be at closing. REAL ESTATE TAXES: No CAUV tax recoupment is planned or factored into this closing. The buyers accept the property’s CAUV status, “as is”. Buyers plan to continue here as agricultural use. Sellers will pay the 2018 taxes due in 2019. Buyers are responsible for any real estate taxes thereafter, 2019 and forward.
